When a woman’s marriage ends, the Quran requires her to observe a waiting period, which it calls an interim, before she may marry again. The length depends on her situation. For a widow, the rule appears in the second sura:
2:234 Those who die and leave wives, their widows shall wait four months and ten days (before they remarry). Once they fulfill their interim, you commit no error by letting them do whatever righteous matters they wish to do. GOD is fully Cognizant of everything you do.
However, sura 65, which deals with waiting periods in the context of divorce, gives different terms for women in other circumstances, including those who are pregnant:
65:4 As for the women who have reached menopause, if you have any doubts, their interim shall be three months. As for those who do not menstruate, and discover that they are pregnant, their interim ends upon giving birth. Anyone who reverences GOD, He makes everything easy for him.
So a widow waits four months and ten days, and a pregnant woman’s interim ends when she gives birth.
The Dilemma
Now take a case that touches both verses. A man dies and leaves behind a pregnant wife, and she gives birth three weeks later. She is a widow, so 2:234 appears to hold her to four months and ten days. She is also pregnant, so 65:4 appears to release her at delivery. Neither verse mentions the other case. Which one governs her?
Many Sunni scholars treat this as a decisive example. The Quran, they say, contains two rules that seem to collide, and only the Prophet’s recorded ruling can settle the matter. Such a ruling appears in Sahih Bukhari.
Narrated Um Salama: (the wife of the Prophet) A lady from Bani Aslam, called Subai’a, become a widow while she was pregnant. Abu As-Sanabil bin Ba’kak demanded her hand in marriage, but she refused to marry him and said, “By Allah, I cannot marry him unless I have completed one of the two prescribed periods.” About ten days later (after having delivered her child), she went to the Prophet (ﷺ) and he said (to her), “You can marry now.”

From this, the argument runs as follows. Without the Hadith, how would Muslims know which period takes precedence? If the Prophet settled it, then the Quran cannot be applied on its own, and Hadith is not an optional commentary but a necessary source of law. It is a tidy argument, and it breaks down when you test it on its own terms.
What follows is an internal critique. I grant the Sunni premises for now: that the report is authentic, and the question is a real one. Even so, the argument proves far less than it claims.
Three Claims Hiding in One
The argument quietly fuses three separate propositions. The first is that a report supplies an answer to a legal question. The second is that the answer genuinely came from Muhammad. The third is that, because it did, the whole corpus of Hadith is an authoritative and necessary source of religious legislation.
Each step needs its own support, and none follows automatically from the one before. A report can offer a wise, sensible ruling and still be historically uncertain; sensible content is not a chain of custody. And even if we grant the second claim for the sake of argument, the leap to the third is enormous. That one ruling reached us faithfully does not tell us that thousands of others did, nor that every one of them was meant to bind every believer forever.
There is a further distinction the argument overlooks. A messenger may speak as a messenger, delivering what he was commanded to deliver, or he may act as a leader and judge, exercising practical wisdom in a situation placed before him. The Quran itself shows the Prophet consulting, being corrected, and being told what he must and must not do. To treat every judgment as the same kind of act is to assume the conclusion the argument was supposed to establish.
More Rulings Are Not a Method
The deeper problem is one of scale. Human circumstances do not come in a finite list.
Suppose a woman’s husband dies after she has begun fertility treatment, and an embryo has been created but not yet implanted. Is she pregnant? Suppose a widow carries a child by a surrogate arrangement. Suppose a woman is widowed while a pregnancy is medically terminated for reasons of her own health. Suppose the husband dies and a pregnancy is discovered only weeks later, or confirmed by a test whose result is disputed. Suppose a child is delivered at twenty weeks and does not survive. Which counts as “delivery,” and does the waiting period end?
No seventh-century narration speaks to these cases, and none could. The Subayʿa report answers one configuration of facts. It does not teach a method for reasoning about the others, and a method is what a changing world requires. A collection of additional rulings is not a substitute for a method of judgment.
The tradition itself concedes this. Classical jurisprudence developed qiyās, reasoning by analogy, and ijtihād, disciplined independent judgment, precisely because the texts ran out. That admission is significant. It means the Hadith literature did not remove the need for human reasoning; it relocated it. Jurists still had to decide which cases resembled which, which reports to prefer when they conflicted, and which rulings were general and which particular. More texts do not shrink the work of judgment. They enlarge the material it must sift.
Does the Quran Really Leave the Question Open?
Return to the two verses and read them as an attentive reader would, without help from anyone.
Verse 2:234 addresses widows as a category. Verse 65:4 addresses a category defined by a different feature, pregnancy: ulātu l-aḥmāl, “those who carry.” One verse is organized around the husband’s death, the other around the woman’s condition. A reader trained in ordinary textual reasoning will notice that when one provision speaks generally, and another speaks specifically, the specific commonly governs its own case, and the general governs the remainder. On that reading, 65:4 carves out pregnant women, and 2:234 covers the widow who is not carrying. The word ajal, “term,” appears in both passages, which invites reading them together rather than setting them against each other.
This is not the only possible reading. Sura 65 opens with divorce, so one can argue that 65:4 addresses divorced women and does not reach the widow. That is exactly how Ibn ʿAbbas read it. In Sunan al-Nasaʾi 3511, he is asked about a woman who gives birth one day after her husband dies, and he says she may not marry until the longer of the two periods has ended. When the verse about the pregnant is recited to him, he answers that it applies only to divorce. A Companion, in other words, reasoned from the text of the Quran in the same way this article does, and reached the opposite conclusion.
Abu Salamah bin ‘Abdur-Rahman said: “It was said to Ibn ‘Abbas concerning a woman who gives birth one day after her husband died: ‘Can she get married?’ He said: ‘No, not until the longer of the two periods has ended.’ He said: ‘Allah says: And for those who are pregnant (whether they are divorced or their husbands are dead), their ‘Iddah (prescribed period) is until they lay down their burden.’ He said: ‘That only applies in the case of divorce.’ Abu Hurairah said: ‘I agree with my brother’s son’ –meaning, Abu Salamah. He sent his slave Kuraib and told him: ‘Go to Umm Salamah and ask her: Was this the Sunnah of the Messenger of Allah?’ He came back and said: ‘Yes, Subai’ah Al-Aslamiyyah gave birth twenty days after her husband died, and the Messenger of Allah told her to get married, and Abu As-Sanabil was one of those who proposed marriage to her.'”
Ali is also reported to have held the longer-period position, and later scholars list him with Ibn ʿAbbas among those who dissented from the majority. Ibn Masʿud, by contrast, is reported to have held that the later revelation about pregnancy governed (Sahih al-Bukhari 4910).
Sulayman ibn Harb and Abu al-Nuʿman said: Hammad ibn Zayd narrated to us, from Ayyub, from Muhammad [ibn Sirin], who said: “I was sitting in a gathering in which ʿAbd al-Rahman ibn Abi Layla was present, and his companions held him in great esteem. He mentioned the longer of the two waiting periods, so I narrated the hadith of Subayʿah bint al-Harith, which I had received from ʿAbd Allah ibn ʿUtbah. Some of his companions then made a gesture toward me [signaling their disapproval]. Muhammad [ibn Sirin] continued: “I noticed this and said, ‘I would indeed be audacious if I were to falsely attribute something to ʿAbd Allah ibn ʿUtbah while he is still in the vicinity of Kufa!’ “He [ʿAbd al-Rahman ibn Abi Layla] became embarrassed and said, ‘But his uncle [ʿAbd Allah ibn Masʿud] did not say that.’ “So I met Abu ʿAtiyyah, Malik ibn ʿAmir, and questioned him. He began narrating to me the hadith of Subayʿah. “I asked him, ‘Did you hear anything from ʿAbd Allah [ibn Masʿud] concerning this matter?’ “He replied: ‘We were with ʿAbd Allah [ibn Masʿud], and he said: “Would you impose the stricter ruling upon her and not grant her the concession? The shorter Surah of Women [Surah 65, al-Ṭalāq] was certainly revealed after the longer one [Surah 2, al-Baqarah]: ‘And those who are pregnant—their waiting period ends when they deliver their pregnancy.’” [Quran 65:4]’”

That disagreement also cuts against the Sunni argument. Sunni theology holds that the Companions were the living embodiment of the Sunnah, the people who watched the Prophet and carried his practice forward. If the Prophet had publicly settled this question, it is hard to see how men as close to him as Ali and Ibn ʿAbbas could have held the opposite view.
Who supported which ruling?
The collections show how the dispute actually unfolded. In Sahih Muslim 1485a, Abu Salama ibn ʿAbd al-Rahman and Ibn ʿAbbas are in the house of Abu Hurayra arguing over a woman who gave birth a few nights after her husband died. Ibn ʿAbbas says she must wait the longer of the two periods. Abu Salama says the birth ends it, and Abu Hurayra sides with him. Nobody in the room cites a ruling of the Prophet. They send Kurayb, Ibn ʿAbbas’s freed slave, to ask Umm Salama, and she reports the Subayʿa episode. The same account appears in Sahih al-Bukhari 4909, the Muwatta of Malik, and Sunan al-Nasaʾi. Notice that Abu Salama’s side of the argument is also Quranic: in Bukhari 4909 he answers Ibn ʿAbbas by reciting 65:4. Both parties were reasoning from the Quran, and neither could close the question with the text alone.
Taken at face value, this means men at the center of the community did not know of any ruling, and the report reached them only because a servant was sent to ask one widow of the Prophet. That leaves a possibility the tradition has to answer: a report attributed to the Prophet may have surfaced in the middle of the dispute to resolve it. I do not claim this is what happened. I claim that a dispute like this is what we would expect to see if the report arrived after the fact, and not what we would expect if the ruling had been common knowledge from the start.
The strongest Sunni reply is that the Companions disagreed only because the report had not yet reached them, and that they yielded when it did. Ibn ʿAbd al-Barr, as quoted by Nawawi, says Ibn ʿAbbas went back on his view. That reply is coherent. But it concedes that the Prophet’s ruling was not public knowledge among those closest to him, and it still asks us to trust one chain of transmission to tell us that a ruling ended the dispute, rather than the dispute producing a ruling.
But notice what that establishes. It establishes that interpretation is required. It does not establish that the Quran is insufficient or that an external collection must be elevated to infallible authority. Every legal culture faces this situation. Constitutions contain clauses that appear to pull against each other; statutes meet facts their drafters never imagined; contracts are ambiguous. Courts reason through them using text, context, purpose, and precedent, and no one concludes that the constitution is worthless unless an additional, supposedly flawless book is attached to it. The existence of a reasonable question is not a proof of inadequacy.
What Was the Waiting Period For?
If we want to apply the verses wisely, we should ask what they are for, and here the Quran gives more than one answer.
In the case of divorce, the waiting period of three menstrual cycles is tied to what lies in the womb and to the possibility of reconciliation: “It is not lawful for them to conceal what GOD has created in their wombs,” and “their husbands have the right to take them back during this period, if they truly desire reconciliation” (2:228). The divorced woman is told to be counted carefully, and the husband is told not to expel her from her home during the period (65:1), which points to a function of protection and of opportunity to reconsider.
Widowhood is different. The widow “shall wait for four months and ten days” (2:234), and the following verse regulates what may be said to her during that interval and when proposals may be made (2:235). Her period is bound up with mourning and with a socially recognized transition. The Quran itself shows that pregnancy identification cannot be the sole purpose, since a woman divorced before the marriage was consummated owes no waiting period at all: “If you marry the believing women then divorce them before you touch them, you are not entitled to any waiting period” (33:49). And if a widow of a marriage a single day old still observes four months and ten days, then paternity is plainly not the only thing at stake.
Today we can detect pregnancy within days, image a fetus, and establish parentage by DNA. This does not mean a Quranic waiting period is automatically canceled, and I do not make that claim. The Quran commands what it commands, and the purposes I have described are inferences, not statements. But it does change the question we are entitled to ask. When the circumstances that gave one purpose its urgency have shifted, must the response remain identical in every respect? Distinguishing what the text explicitly commands from what we infer about its rationale is exactly the work of judgment, and it is work that cannot be handed off to a narration.
A Prophetic Decision and an Eternal Formula
Now grant everything. Suppose the Subayʿa narration is perfectly authentic. What would it show?
It would show how Muhammad resolved a matter involving a particular woman in particular circumstances. Whether that resolution was a universal divine command, a practical application of a command already given, or a context-bound judgment is a further question, and the report does not announce its own category.
The strongest Sunni reply is that a ruling issued by the Prophet in his prophetic capacity is binding legislation, and that we are not free to relabel inconvenient rulings as local decisions. That is a coherent position. But it carries a burden. To claim that this particular report preserves a timeless divine ruling, rather than a wise application to one case, one must show that it was delivered as law and not as counsel, that it was transmitted without distortion, and that nothing in the Quran itself already supplied its substance. Notice, too, that in this very case the narration tells us the Prophet’s answer came as a response to a dispute and a question; it does not tell us he meant to close the topic for every society to come.
The Quran’s guidance can carry continuing authority without our presuming that every reported historical application of it is an immutable statute.
The Foundation of Reasoning
If not a catalog of answers, then what? The Quran offers something else: a set of commitments that can steer judgment across an effectively unlimited range of circumstances.
It commands that when you judge among people, you “judge with justice” (4:58). It insists on justice even when it costs us, even “against your own selves” (4:135), and even when we are moved by hatred: “Do not let your hatred for any people cause you to commit injustice. You shall be absolutely just, for this is closer to righteousness” (5:8). It forbids pursuing claims without knowledge: “Do not pursue any information that you have no knowledge of; (God has provided you) the hearing, the eyesight, and the mind, all these will be questioned” (17:36). It praises “those who listen to all statements and follow the best thereof” (39:18), and it describes believers as those who “conduct their affairs by mutual consultation” (42:38).
Taken together, these are not slogans. They amount to a method: pursue justice, avoid harm, demand evidence, weigh competing views and adopt the best, and decide communal matters by deliberation. When the pregnant widow’s case arrives in a new form, whether through surrogacy, embryo preservation, or an unusual medical event, these principles tell us how to think, whom to consult, and what standard to apply.
This approach does not promise infallibility. Human judgment errs. But neither does adding Hadith make interpretation infallible, since the reports themselves must be authenticated, reconciled, and applied by fallible people. The relevant distinction is between divine authority and human attempts to understand it. The Quran describes itself as inspired “that I may warn you therewith, as well as everyone it reaches” (6:19). Its authority is the warning and the guidance; our responsibility is to reason well in light of it.
Moving the Question Is Not Answering It
Gather the threads. The objection began by asking how Muslims can decide legal questions without Hadith. But resorting to Hadith raises its own questions. Which reports are authentic? How do we reconcile those that conflict? Which preserve universal law and which preserve circumstance? And what do we do when no report addresses the case at all? Every one of these requires human reasoning. The appeal to Hadith does not dissolve the interpretive challenge; it carries it to another library.
Even if one rejects that not every narration is false or worthless. The issue is not whether Hadith can contain useful answers. The issue is whether having useful answers establishes divine authority. A good answer is a good answer, whoever gave it, but usefulness is not the same thing as binding revelation.
Guidance Versus a Catalog
What does it mean for scripture to be sufficient? Surely it cannot mean that every possible circumstance must be spelled out in advance. No book could anticipate every medical development, legal dispute, or moral dilemma that future generations would encounter. Sufficiency means something more fundamental: that revelation provides the authoritative foundation from which people can reason, judge, and act responsibly.
18:109 Say, “If the ocean were ink for the words of my Lord, the ocean would run out, before the words of my Lord run out, even if we double the ink supply.”
The Quran does precisely this. It establishes commands, boundaries, and principles of justice while repeatedly calling on human beings to exercise reason, seek knowledge, and deliberate over their affairs. It does not promise to eliminate the need for judgment. It teaches us how to exercise it.
The pregnant widow illustrates the distinction. The Quran establishes a waiting period for widows in 2:234 and a provision for pregnant women in 65:4. Determining how these provisions apply when both circumstances coincide is a matter of interpreting the revelation itself. The existence of a question does not establish that the answer must come from outside the Quran. Nor does the fact that a Hadith supplies an answer establish that the Hadith carries divine authority.
This is where the argument from necessity fails. It assumes that because a narration resolves a legal question, the narration must be necessary for understanding God’s law. But resolving a question and possessing the authority to legislate are two entirely different things. A ruling does not become divine legislation simply because someone attributes it to the Prophet. The burden remains on those who claim that God authorized such reports as an independent source of religious law.
Worse, appealing to Hadith does not eliminate the very uncertainty it supposedly resolves. It introduces another set of questions: Which reports are authentic? Which contradict one another? Which apply universally? Which reflect particular historical circumstances? And what happens when no narration addresses the situation at hand? Each question demands further human interpretation. The appeal to Hadith does not remove the need for reasoning; it merely transfers that reasoning from God’s revelation to a body of reports attributed to human transmitters.
The distinction is fundamental. The Quran is the source of authority; human reasoning is the means by which we understand and apply it. Reasoning is fallible, but its fallibility does not justify elevating another collection of texts to divine authority. It calls instead for humility, careful examination, consultation, and a willingness to correct our judgments in light of the Quran.
Ultimately, the argument from necessity confuses two very different things: the need for divine guidance and the desire for a ready-made answer to every question. The Quran provides the former without pretending to supply the latter. Its sufficiency does not depend on eliminating every ambiguity or relieving human beings of the responsibility to think. Indeed, its repeated appeals to reason, justice, knowledge, and consultation make that responsibility part of the guidance itself.
5:101 O you who believe, do not ask about matters which, if revealed to you prematurely, would hurt you. If you ask about them in light of the Quran, they will become obvious to you. GOD has deliberately overlooked them. GOD is Forgiver, Clement.
The question, then, is not whether a Hadith can provide an answer to a difficult case. Anyone can provide an answer. The question is what gives that answer religious authority. For those who uphold the Quran alone, that authority belongs to God’s book, the Quran, which is the only book of law the messenger was authorized to deliver. The Quran which He gave is the standard against which every human judgment must be measured.
The Quran does not need to answer every conceivable question for it to provide the foundation by which questions are answered.
6:114 Shall I seek other than GOD as a source of law, when He has revealed to you this book fully detailed? Those who received the scripture recognize that it has been revealed from your Lord, truthfully. You shall not harbor any doubt.
